1. Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and PINPOINTSURF, LLC, a North Carolina limited liability company ("pinpointsurf," "we," "us," or "our"). They govern your access to and use of:

  • the website at pinpointsurf.com and its subdomains;
  • the pinpointsurf mobile applications for iOS and Android (the "App"); and
  • all related forecasts, data, maps, content, notifications, APIs, and features

(collectively, the "Services").

By creating an account, purchasing a subscription, or otherwise accessing or using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

These Terms function as the end user license agreement ("EULA") for the App. Where you download the App from the Apple App Store, Apple's Standard End User License Agreement also applies; in the event of a conflict regarding your license to the App, the Standard EULA controls.

2. Changes to These Terms

We may revise these Terms from time to time. For material changes, we will provide notice by email to the address associated with your account, by in-app notice, or both, at least fourteen (14) days before the changes take effect. For non-material changes, updating the "Last Updated" date above constitutes notice. Your continued use of the Services after the effective date of revised Terms constitutes acceptance. If you do not agree to revised Terms, your sole remedy is to stop using the Services and, if applicable, cancel your subscription.

3. Eligibility

You must be at least thirteen (13) years old to use the Services. If you are under eighteen (18), you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Services, you represent that you meet these requirements.

4. Accounts

4.1 Registration. Certain features require an account. You agree to provide accurate, current information and to keep it updated.

4.2 Security. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at support@pinpointsurf.com of any unauthorized use.

4.3 One account per person. Accounts are personal to you and may not be shared, sold, or transferred.

4.4 Suspension and termination by us. We may suspend or terminate your account if you violate these Terms, if we reasonably suspect fraudulent, abusive, or unlawful activity (including automated data extraction under Section 8), or if required by law. Where practicable, we will provide notice and an opportunity to cure before termination.

4.5 Deletion by you. You may delete your account at any time from within the App (tap your initials in the top bar → Account → Delete account) or by contacting support@pinpointsurf.com. Deletion of your account does not cancel an active App Store or Google Play subscription — those must be cancelled separately through your Apple or Google account settings as described in Section 5. Website (Stripe) subscriptions are cancelled automatically when your account is deleted. Data handling upon deletion is described in our Privacy Policy.

5. Subscriptions, Billing, and Cancellation

5.1 Tiers. The Services include a free tier and paid subscription tiers with additional features (such as an extended forecast range and additional data). The features, price, and billing period of each tier are displayed at the point of purchase before you subscribe.

5.2 Billing. How you are billed depends on where you subscribe:

  • In the App: subscriptions are processed by Apple (through your Apple ID) or Google (through your Google Play account), not by pinpointsurf directly. Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
  • On the website: subscriptions are processed by our payment provider, Stripe. Your payment method is charged at confirmation of purchase and at each renewal. pinpointsurf does not receive or store your full card number; payment details are collected and stored by Stripe.

Regardless of purchase channel, your subscription is tied to your pinpointsurf account and works across all your devices.

5.3 Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price for your tier, unless you cancel at least twenty-four (24) hours before the end of the current period. Your account is charged for renewal within twenty-four (24) hours prior to the end of the current period.

5.4 How to cancel. You must cancel through the channel where you subscribed:

  • iOS: Settings → [your name] → Subscriptions, or the App Store app → account → Subscriptions.
  • Android: Google Play app → account → Payments & subscriptions → Subscriptions.
  • Website (Stripe): through your Account page at pinpointsurf.com.

Deleting the App does not cancel your subscription, and deleting your account does not cancel an App Store or Google Play subscription (see Section 4.5). Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.

5.5 Refunds.

  • App Store / Google Play purchases: refund requests are governed by, and must be submitted through, the applicable platform's refund process. pinpointsurf cannot issue refunds for purchases billed by Apple or Google.
  • Website (Stripe) purchases: except where required by applicable law, payments are non-refundable and there are no refunds or credits for partial billing periods. If you believe you were billed in error, contact support@pinpointsurf.com and we will review the charge in good faith.

5.6 Price changes. We may change subscription prices. Price changes apply no earlier than your next renewal, and you will receive notice consistent with the applicable platform's requirements (which may include the opportunity to consent or cancel before the new price takes effect).

5.7 Free trials and promotional offers. If a subscription includes a free trial or introductory price, the terms (duration, subsequent price) are disclosed at the point of purchase. Unless you cancel at least twenty-four (24) hours before the trial ends, the subscription converts to a paid subscription and your platform account is charged.

5.8 Feature changes. We may add, modify, or remove features of any tier. If we materially reduce the features of a paid tier during your paid period, your remedy is to cancel per Section 5.4.

6. Platform Terms (Apple and Google)

If you downloaded the App from the Apple App Store, the following applies: these Terms are between you and pinpointsurf only, not Apple. Apple has no obligation to furnish maintenance or support for the App and is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims of noncompliance with legal or regulatory requirements, and consumer protection claims. In the event the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the App, and Apple has the right to enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms of agreement when using the App.

If you downloaded the App from Google Play, you must also comply with the Google Play Terms of Service.

7. License to Use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use. All rights not expressly granted are reserved by pinpointsurf.

8. Acceptable Use and Data Protection

The forecast data, surf quality assessments, maps, and model outputs available through the Services (the "Forecast Data") are proprietary works produced by pinpointsurf's modeling systems. You agree that you will not, and will not assist or permit any third party to:

  1. scrape, crawl, harvest, or use any automated means (including bots, scripts, or headless browsers) to access the Services or extract Forecast Data;
  2. copy, store, republish, redistribute, sell, sublicense, or make available any substantial portion of the Forecast Data, whether or not modified, including in derivative products or datasets;
  3. use the Forecast Data to train, fine-tune, calibrate, or validate any machine learning model or competing forecasting system;
  4. reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, model configurations, or methodologies underlying the Services, except to the extent such restriction is prohibited by applicable law;
  5. circumvent, disable, or interfere with any access controls, subscription gates, rate limits, or security features of the Services;
  6. access the Services through any interface other than those we provide;
  7. share account credentials or use the Services on behalf of any commercial forecasting, media, or data-aggregation operation without a separate written license from us;
  8. interfere with or disrupt the integrity or performance of the Services; or
  9. use the Services for any unlawful purpose.

Limited personal sharing — for example, a screenshot of a forecast shared with friends — is permitted, provided pinpointsurf attribution is not removed.

Violation of this Section is grounds for immediate account termination without refund (refunds remaining subject to Section 5.5) and may subject you to legal action.

9. Assumption of Risk — Read Carefully

Surfing and other ocean activities are inherently dangerous and can result in serious injury or death. Hazards include, without limitation, large or powerful waves, rip and littoral currents, shallow sandbars, reefs and other submerged objects, marine life, weather changes, cold water, and other water users.

The Forecast Data consists of predictions generated by numerical models. Models can be, and sometimes are, wrong. Actual conditions may differ materially from forecasts in wave height, period, direction, wind, timing, and quality. Forecasts may be delayed, unavailable, or based on incomplete or erroneous input data.

You acknowledge and agree that:

  1. the Services are provided for general informational purposes only;
  2. the Services are not a safety device, hazard warning system, or substitute for your own judgment, experience, on-site observation of conditions, or official information;
  3. you should always consult official sources — including National Weather Service forecasts, warnings, and advisories, and any local beach or lifeguard warnings — before entering the water, and official warnings supersede anything shown in the Services;
  4. the Services are not intended for navigation, maritime operations, commercial decision-making, or emergency response; and
  5. you voluntarily assume all risks associated with ocean activities undertaken in reliance on, or after consulting, the Services, including the risk of serious injury or death.

10. Intellectual Property

The Services — including the Forecast Data, software, algorithms, model configurations, visualizations, text, graphics, and design — are owned by pinpointsurf or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws. "pinpointsurf," and the associated logo are trademarks of PINPOINTSURF, LLC and may not be used without our prior written permission.

The Services incorporate observational data from third-party sources, including U.S. government sources such as NOAA and the National Data Buoy Center. Such underlying government data is not claimed as proprietary; pinpointsurf's proprietary rights extend to its model outputs, derived products, quality assessments, compilations, and presentation.

If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

11. Third-Party Services and Links

The Services rely on third-party services (such as mapping, hosting, authentication, and payment providers) and may contain links to third-party websites. We do not control and are not responsible for third-party services or content, and links do not imply endorsement. Your use of third-party services is governed by their own terms and privacy policies.

12. Disclaimers; Limitation of Liability

12.1 Disclaimer of warranties. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL FORECAST DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, PINPOINTSURF DOES NOT WARRANT THAT THE FORECAST DATA WILL BE ACCURATE, COMPLETE, TIMELY, OR RELIABLE, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12.2 Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PINPOINTSURF, ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES OR YOUR RELIANCE ON ANY FORECAST DATA, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PINPOINTSURF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.3 Cap. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PINPOINTSURF'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PINPOINTSURF FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

12.4 Savings clause. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent such laws apply to you, some of the above exclusions and limitations may not apply, and pinpointsurf's liability will be limited to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless pinpointsurf and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your violation of any law or the rights of any third party, or (c) your misuse of the Services or Forecast Data.

14. Termination

These Terms remain in effect while you use the Services. Sections 8 through 17 survive termination. Upon termination of your account for any reason, your license under Section 7 ends immediately.

15. Governing Law and Venue

These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You and pinpointsurf agree to the exclusive jurisdiction and venue of the state and federal courts located in New Hanover County, North Carolina, and waive any objection to such venue. Nothing in this Section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

16. General

16.1 Entire agreement. These Terms, together with the Privacy Policy and any point-of-purchase subscription disclosures, are the entire agreement between you and pinpointsurf regarding the Services and supersede all prior agreements.

16.2 Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full force.

16.3 No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

16.4 Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

16.5 Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, network failures, or failures of third-party data sources.
